RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

In consideration of being permitted to purchase and use for any purpose any product offered by ICE, LLC, the undersigned for himself, his personal representatives, heirs, and next of kin:

1. Acknowledges, agrees and represents that he has reviewed all information, limitations, or warnings of any kind related to the product being offered by ICE, LLC.
2. Understands that the product being offered includes experimental technology in which testing has not been completed. Therefore, the Company makes no representations concerning results of the products use and/or the potential for any side effects.
3. Understands that the Hardware product is only to be used with I.C.E. therapy solutions
4. Hereby waives, discharges and covenants not to sue I.C.E., LLC, its owners, officers, directors, agents, employees, and releases from any and all liability the undersigned, his personal representatives, assigns, heirs, and next of kin for any and all loss or damage, and any claim or demands therefor on account of injury to the person or property or resulting in death of the undersigned arising out of or related to the purchase or use for any purpose of any product offered by I.C.E., LLC, whether caused by the negligence of the Company or otherwise.
5. Hereby agrees to indemnify and hold harmless the Company, its owners, officers, directors, agents, employees, and each of them from any loss, liability, damage, or cost he/she/they may incur arising out of or related to the purchase or use of “the product” whether caused by the negligence of the Company or otherwise.
6. Hereby assumes full responsibility for any risk of bodily injury, emotional distress, pain and suffering, death or property damage arising out of or related to the purchase or use of “The Product”.
7. Hereby agrees and acknowledges that the Company makes no representations whatsoever about the effectiveness or safety of the product(s) purchased or used by the undersigned.
8. Hereby agrees that this release and waiver of liability, assumption of risk and indemnity agreement extends to all acts of negligence by the Company, its owners, officers, directors, agents, and employees, and is intended to be as broad and inclusive as is permitted by the laws of the State in which the product is sold, purchased, and/or marketed and that if any portion of this agreement is held to be invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. I have read this release and waiver of liability, assumption of risk and indemnity agreement fully understand its terms, understand that I have given up substantial rights by signing it and have signed it freely and voluntarily without any inducement, assurance or guarantee being made to me and intend my signature to be complete and unconditional release of all liability to the greatest extent allowed by law.
9. Use the Bio Resident Therapy Hardware as designed with the wire clips only.
10. I.C.E. is not liable for other uses of the product!
11. The current hardware vendor (Fiio) is not liable for this application of the products.
